World Rugby Science Network Terms and Conditions of Use (“Terms and Conditions”)

The World Rugby Science Network has been developed to provide a forum for health professionals actively involved in the sport of Rugby to exchange ideas, make comment on literature, impending or completed research, upcoming conferences and related information. Users of the World Rugby Science Network make all postings at their own risk. The information provided on the World Rugby Science Network (and its web site) is for general informational and educational purposes only.

World Rugby’s (including its associated companies, including its operating entity World Rugby Limited ("World Rugby", “us”, “our”, or “we”) only role is in relation to making available the forum for those postings to be made and, as further set out below, does not provide any assurance or recommendation with respect to the accuracy, legality or reliability of any information provided in the World Rugby Science Network. The forum, including any content therein, is made available strictly on the basis that World Rugby does not accept any liability to any person or entity for loss, cost or damage howsoever arising out of any posting and/or reliance on and/or use of the information and/or posting contained in the World Rugby Science Network. The disclaimer and terms and conditions applicable to the World Rugby Player Welfare site at playerwelfare.worldrugby.org, shall also apply to the World Rugby Science Network and the site, sciencenetwork.worldrugby.org, in conjunction with these Terms and Conditions.

Terms & Conditions: World Rugby Science Network

World Rugby is making available this Internet site, sciencenetwork.worldrugby.org and pages within that domain (the "Site"), and related services subject to your compliance with these Terms and Conditions of set forth below. PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS SITE. BY ACCESSING AND USING THIS SITE, YOU HAVE AGREED TO THESE TERMS AND CONDITIONS AS THEY APPEAR AT THE TIME OF YOUR USE. IF YOU DO NOT AGREE TO ALL OF THESE TERMS AND CONDITIONS, YOU MAY NOT USE THIS SITE.

World Rugby may make changes and update these Terms and Conditions at any time. Please check these Terms and Conditions posted at sciencenetwork.worldrugby.org periodically, because your continued use of the Site will mean you accept those changes and updates.

Section 1. Privacy:

Some personal information may be requested by World Rugby when you express a wish to take part in certain activities available on the Site, or otherwise to facilitate access to and/or use of certain parts of the Site (such as when you wish to participate in the Interactive Areas of the Site (see Section 2 below for further information about such Interactive Areas), or when you register for World Rugby Passport). (World Rugby Passport permits you access to various training and education web sites provided by World Rugby on a range of topics from educational resources around the Laws of the Game of Rugby to physical preparation for the playing of the sport of Rugby.)

The personal information collected in respect of taking part in certain activities available on the Site, or otherwise to facilitate access to and/or use of certain parts of the Site (including, for example, the Interactive Areas of the Site) may include, but is not limited to the following: name, a valid e-mail address or other alternative contact details, details of your level of involvement in the sport of Rugby (including as a health professional, the name of the entity or educational establishment you are currently working for, and/or your role within that organisation), your Rugby team or club, your age, country of residence, nationality, gender, and/or your confirmation that you have read and agree with the Terms and Conditions applicable to the Site.

In order to access the Interactive Areas of the Site and/or services available on this Site or the Interactive Areas, you may be asked to register, or sign in with an e-mail address and to choose a password. In this case your chosen password and other information (including the aforementioned personal information) are collected, retained and used to create a unique logon for you to access the services or a particular part of the Site. You must keep your logon details and password safe. You must not, without the prior written approval of World Rugby, make available and/or provide to any other person or entity:

(i) your logon details and/or password to the Site;
(ii) access to and/or use of the Site;
(iii) distribute copies of and/or excerpts from the Site.

World Rugby (or its representatives on its behalf) reserves the right to contact you via a valid e-mail address or other alternative contact details you provide to World Rugby regarding:

(i) your wish to take part in certain activities available on the Site, or access to and/or use certain parts of the Site (in particular, the Interactive Areas);
(ii) your uploads, postings, emails or any Content you transmit to and/or via the Site.

If you otherwise contact us (via e-mail or post) and provide us with your personal information in that correspondence, we may keep a record of that correspondence.

Section 2. Rules of Conduct for Interactive Areas:

The World Rugby Science Network comprises interactive areas ("Interactive Areas") where users of the World Rugby Science Network can make postings. You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such Content originated. This means that you, not World Rugby, are entirely responsible for all Content that you upload, post, email or otherwise transmit using the Site. World Rugby does not control the Content posted using the Site and as such does not guarantee the accuracy, integrity or quality of such Content.

You understand that by using the Site, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstance will World Rugby be liable in any way for any Content, including, but not limited to, errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content uploaded, posted, emailed or otherwise transmitted or hosted using the Site.

You acknowledge that World Rugby is under no obligation to pre-screen Content, but that World Rugby shall have the right to refuse or move or delete any Content that is posted to the Site (see Section 3 of these Terms and Conditions in this respect), including without limitation any Content that violates these Terms and Conditions, or is otherwise objectionable.

You agree that you must evaluate, and bear all rights and obligations associated with the use of any Content, including reliance on the accuracy, completeness or usefulness of such Content. You also acknowledge and agree that World Rugby may preserve or remove Content and may disclose Content, including information about your account or your use of the Site, to any third party if required to do so by law or in the good faith belief that such preservation, removal or disclosure is necessary to:

(a) comply with legal process;

(b) enforce these Terms and Conditions;

(c) respond to claims that any Content violated the rights of third parties; or

(d) protect the rights, property, or safety of World Rugby, its employees or agents, or the public (including such individual’s personal safety).

ANY RELIANCE ON CONTENT POSTED IN AN INTERACTIVE AREA IS AT YOUR OWN RISK.

You agree that it shall be a material violation of these Terms and Conditions if you are engaged in any of the following activities:

(a) uploading, posting, emailing or otherwise transmitting any Content that is, in World Rugby's sole discretion, unlawful, harmful, threatening, abusive, harassing, tortuous, antisocial, disruptive, defamatory, slanderous, inaccurate, vulgar, obscene, libellous, invasive of another's privacy, hateful, hostile towards any individual or entity, or racially, ethnically or otherwise objectionable;

(b) harming minors in any way;

(c) impersonating any person or entity, including, but not limited to, a World Rugby employee, or falsely stating or otherwise misrepresenting your affiliation with a person or entity;

(d) forging headers or otherwise manipulating identifiers in order to disguise the origin of any Content transmitted through the Site;

(e) adopting of names and addresses for the purpose of cyber squatting;

(f) uploading, posting, emailing or otherwise transmitting any Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information, including without limitation information that is learned or disclosed as part of employment relationship(s) or under nondisclosure agreement(s));

(g) uploading, posting, emailing or otherwise transmitting any Content that infringes any patent, trademark, trade secret, copyright, publicity, privacy, or other proprietary or intellectual property right ("Rights") of any individual or entity;

(h) uploading, posting, emailing or otherwise transmitting any Content (including any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment);

(i) interfering with or disrupting the Site, or servers or networks connected to the Site, or disobeying any requirements, procedures, policies or regulations of networks connected to the Site;

(j) intentionally or unintentionally violating any applicable local, provincial, state, national or international law;

(k) "stalking" or otherwise harassing another;

(l) such activities as are commercial, business-related or advertises or offers to sell any products, services or otherwise (whether or not for profit), or solicits others (including solicitations for contributions or donations, any unsolicited or unauthorised advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes", or any other form of such solicitation) without the prior written approval of World Rugby;

(m) uploading, posting, emailing or otherwise transmitting personal information, or otherwise harvesting or collecting information of any third party individual or entity (such as name, e-mail addresses, home address, date of birth etc.), without their consent (Please note that this Site is not designed to capture, nor does World Rugby wish, by or via the Site, to receive, any information from which a person is or may be identified. Please ensure that no such information is included in your uploads, postings, emails or any Content transmitted to and/or via the Site and/or otherwise to World Rugby);

(n) uploading, posting, email or otherwise transmitting material that does not generally pertain to the designated topic or the relevant Content of the Site;

(o) violating any specific guidelines applicable to the Site, including relevant restrictions and/or procedures

(p) engaging in any other conduct that restricts or inhibits any other person from using or enjoying the Interactive Areas, or which, in the judgment of World Rugby, exposes World Rugby or any of its customers or suppliers to any liability of any type.

Any uploads, postings, emails or any Content you transmit to and/or via the Site, will only be retained for as long as it is required for the operation of the Site and/or its Interactive Areas, including for example, as long as is relevant and/or applicable to the particular ideas, comments on literature, impending or completed research, upcoming conferences and related information submitted via the Interactive Areas.

Section 3. General use of the Interactive Areas of the Site:

World Rugby is under no obligation or responsibility to moderate, monitor, review, reject, remove, delete or edit uploads, postings, emails or any Content transmitted to and/or via the Site and assumes no responsibility or liability arising from such uploads, postings, emails or any Content, nor for any error, omission, infringement, defamation obscenity, or inaccuracy contained therein.

Notwithstanding the foregoing, World Rugby may and reserves the right, from time to time, to:

a) moderate, monitor and/or review uploads, postings, emails or any Content transmitted to and/or via the Site for any reason (including before or after such Content and/or other material uploaded, posted, e-mailed and/or transmitted by you is published and/or made available on the Site);
b) reject, remove, permanently delete and/or edit uploads, postings, emails or any Content transmitted to and/or via the Site for any reason (whether before or after they are published and/or made available on the Site), including but not limited to where such transmissions violate these Terms and Conditions (or is otherwise objectionable) and where a period of time, as determined by World Rugby, has passed since such transmissions were published and/or made available on the Site;
c) block and/or prohibit future uploads, postings, emails or any Content transmitted to and/or via the Site from any particular Site user (i.e. individual or entity) who repeatedly violate these Terms and Conditions (including by suspending your Site user account and/or login). We may effect such blocking or prohibitions by refusing uploads, postings, emails or any Content transmitted to and/or via the Site from specific e-mail addresses or IP addresses, or through other means, as necessary, including prohibiting of the taking part in certain activities available on the Site, or otherwise prohibiting access to and/or use of certain parts of the Site.

We also reserve the right to revise and/or amend our policies (and the terms and conditions of this Section 3) in this regard from time to time, in our judgement, to address issues that may arise from time to time and/or changes in our operations or the law.

Section 4. Disclaimer Regarding Medical Advice:

Any specific tests, products, or procedures that may be mentioned on the Site, whether by World Rugby, or by other members of the World Rugby Science Network are for information and educational purposes only, and World Rugby does not recommend or endorse any of them. Nothing on this Site shall be considered or is intended to be and/or to constitute the practice of or furnishing of medical, nursing, or professional health care advice, diagnose, consultation or treatment. You rely on any information provided by World Rugby, its sponsors and advertisers and other users of the Site at your own risk. World Rugby assumes no liability or responsibility either for the contents of any material provided on the Site, or for damage or injury to persons or property arising from any use of any product, information, idea, or instruction contained in such information or materials. World Rugby reserves the right in its sole discretion to change or discontinue any aspect or feature of this Site at any time without prior notice.

You agree that you will not use this Site, including without limitation to upload, post, email or otherwise transmit any Content (and/or other material) to and/or via the Site that is not your own without the express permission of the respective owner/holder of the Rights.

If you upload, post, email or otherwise transmit any Content (and/or other material) to and/or via the Site you confirm that no third party has any Rights over any such material and that you have complied with all applicable laws and legal obligations. All material on this Site, including (but not limited to) images, illustrations, audio clips and video clips, is protected by copyrights that are owned or controlled by World Rugby or by other parties that have licensed their material to World Rugby (or posted to the Site pursuant to a user agreement with World Rugby). Section 10. General Security of the Site:

We use a variety of security technologies and procedures to help protect the Site from unauthorised access and use. As effective as modern security practices are, no physical or electronic security system is entirely and/or completely secure (including without limitation in respect of the transmission of information via the internet), and your interaction with the Site may involve the transfer of information to countries outside of the European Economic Area (EEA). You expressly agree that exclusive jurisdiction for any dispute with World Rugby, or in any way relating to your use of the Site, resides in the courts of England, and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of England in connection with any such dispute including any claim involving World Rugby or its affiliates, subsidiaries, employees, contractors, officers, directors, telecommunication providers and content providers.

These Terms and Conditions are governed by the laws of England, without respect to its conflict of laws principles. If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect. No waiver of any of these Terms and Conditions shall be deemed a further or continuing waiver of such term or condition or any other term or condition.

Section 12. Complete Agreement:

Except as expressly provided in a particular "legal notice" on the Site, these Terms and Conditions constitute the entire agreement between you and World Rugby with respect to the use of the Site and any content contained therein. The section titles in these Terms and Conditions are for convenience only and have no legal or contractual effect or significance.
